Learning Lot — Family Addendum

This Family Addendum applies to every Family who uses Learning Lot to find, be introduced to, or engage a Tutor. It supplements the Learning Lot Terms of Use (the "Master Terms"), which apply to you in full. Capitalized terms have the meanings given in the Master Terms.
By affirmatively accepting this Addendum through Learning Lot's onboarding process, you agree to be bound by the Master Terms and this Addendum. Your continued use of the Services is subject to these terms.
Where this Addendum conflicts with the Master Terms, this Addendum controls with respect to Families.
F1. Learning Lot Fees
Learning Lot may charge fees for Platform access, matching, concierge services, or other Services. The applicable fee and the Services included will be disclosed to you before you purchase.
For the current Beta offering, Learning Lot charges a one-time fee for access to Learning Lot's Services during the applicable Beta period. This fee does not automatically renew.
Fees paid to Learning Lot are separate from any compensation you agree to pay a Tutor for tutoring Sessions. Tutor compensation is addressed in Section F3.
Except as otherwise disclosed at the time of purchase or required by applicable law, fees paid to Learning Lot are non-refundable once the applicable Services have begun. Learning Lot may issue a refund or credit in its discretion.
F2. Your Responsibilities
As set out in Section 1.4 of the Master Terms, you — not Learning Lot — are responsible for evaluating and selecting any Tutor you choose to engage and for the Family responsibilities described below.
Specifically, you are responsible for:
- Interviewing each Tutor and satisfying yourself as to their suitability for your child
- Interviewing each Tutor and satisfying yourself as to the Tutor's qualifications, experience, suitability, and fit for your child
- For Sessions taking place in a private home, ensuring that a parent or guardian remains on the premises unless you and the Tutor expressly agree to a different arrangement in writing before the Session. If you agree to a different arrangement, you are responsible for determining that the arrangement is appropriate for your child. Learning Lot does not supervise Sessions or approve or assume responsibility for any alternative arrangement between you and a Tutor.
- Ensuring the Session location is safe and suitable
- Communicating any allergy, medical condition, learning difference, behavioral need, or other information a Tutor reasonably needs in order to keep your child safe
- Agreeing rates, scheduling, cancellation terms, and payment arrangements directly with the Tutor
- Complying with your own legal and tax obligations arising from the arrangement (see Section F5)
Where we suggest a location — for example, a café or library for a first session — that is a suggestion only. We do not inspect, assess, or take responsibility for the safety or suitability of any location.
Learning Lot's review of Tutors is limited and does not substitute for your own evaluation. See Section 1.3(a) of the Master Terms.
Background check status is information, not assurance. Where a Tutor profile displays a background check status indicator, that indicator means only that a third-party provider completed a check on the date shown and the result satisfied Learning Lot's then-current eligibility criteria. It is not a guarantee of the Tutor's character, fitness, or safety and does not replace your own evaluation of the Tutor. See Section 1.3(f) of the Master Terms.
Introductory Sessions. You and a Tutor may agree to an introductory Session to assess mutual fit. Neither you nor the Tutor is obligated to continue the tutoring relationship following an introductory Session.
F3. Payments to Tutors
For tutoring Sessions, you pay your Tutor directly on terms you agree with them. Learning Lot does not process, collect, or hold those payments and is not a party to that arrangement or to any dispute about it.
F4. If a Match Isn't Right
We want every match to work, and sometimes one doesn't.
If a Tutor is not the right fit for your child, contact us at hello@learninglot.co within 14 days after your first Session with that Tutor, and we will provide one replacement Introduction at no additional Learning Lot fee.
This is a matching remedy only. It does not entitle you to a refund of any amount paid directly to a Tutor.
Safety concerns. If you have any concern about a Tutor's conduct or your child's safety, contact us immediately at hello@learninglot.co or (510) 788-0327. Safety reports are not subject to any time limit and are not conditioned on your subscription status. If a child is in immediate danger, contact emergency services first.
Learning Lot may review safety reports and may suspend or remove a Tutor from the network or take other action it considers appropriate, including making reports to authorities where required or appropriate.
F5. Tax Treatment of Your Arrangement with a Tutor
Learning Lot does not determine or advise on the tax, employment, or other legal classification of your arrangement with a Tutor. Depending on the facts and circumstances of your arrangement, including where and how regularly services are provided and the degree of direction you exercise, you may have tax, withholding, reporting, employment, or other legal obligations.
You are solely responsible for determining and complying with any obligations that apply to your arrangement with a Tutor. Learning Lot does not withhold taxes on your behalf, issue tax forms relating to payments you make directly to a Tutor, or provide legal or tax advice. You should consult your own advisor if you have questions.
F6. Your Child's Information
(a) You control what you share. You decide what information about your child to provide to Learning Lot and to Tutors. Provide what a Tutor reasonably needs to teach and to keep your child safe.
(b) Parental consent. By providing information about a child, you represent that you are the child's parent or legal guardian, or are otherwise authorized to provide that information, and you authorize Learning Lot to collect, use, and disclose that information as described in our Privacy Policy.
(c) Children's use of the Platform. Children may not create accounts, log in to, or otherwise use the Platform directly. All information about your child must be provided by you or another parent or legal guardian through an adult account. Your rights with respect to information about your child are described in our Privacy Policy.
(d) Photographs and recordings. No Tutor, Family, or other User may photograph, film, or record your child without your prior written consent. If you consent to Learning Lot using an image of your child in marketing, that consent will be requested separately and may be withdrawn at any time.
F7. Your Conduct
You agree to treat Tutors with respect and professionalism, to honor scheduling and payment commitments you make, to provide reasonable notice of cancellation, and to maintain a safe and appropriate environment for Sessions.
We may suspend or terminate your account for harassment or abuse of a Tutor or another Family, repeated failure to pay a Tutor as agreed, providing false information about your child's needs where it creates a safety risk, or any conduct that endangers any person.
F8. Group Sessions
(a) Groups we help form. Where a shared group appears to be a good fit, we may introduce you to other Families as well as to a Tutor. Whether to join a group is entirely your decision.
(b) How groups work. Session logistics, scheduling, and how the Tutor's fee is shared among participating Families are agreed among the Families and the Tutor. Learning Lot does not set the Tutor's rate, determine how costs are divided, or collect or hold any payment. Each participating Family remains responsible for complying with the supervision requirements in Section F2 unless the Families and Tutor expressly agree to another arrangement.
(c) Other Families. Learning Lot does not screen Families, children, or household members. You are responsible for deciding whether a particular group is appropriate for your child — including where Sessions will take place and who else will be present.
(d) Your child's information. In a group Session your child may be present with children from other Families. You agree not to photograph, record, or share information about another Family's child without that Family's consent.
F9. Termination
Any provisions that by their nature should survive termination, including provisions relating to payments, privacy, tax responsibility, liability, and dispute resolution, will survive termination, together with the surviving provisions of the Master Terms.
